INTRODUCTION

This document outlines the terms and conditions for web hosting services provided by Cherished Solutions, LLC. By using our web hosting services, you agree to comply with and be bound by the following terms and conditions. These terms have been updated to reflect current legal requirements and industry standards as of 2025.

1. ACCOUNT SETUP

We will establish your account after receiving payment and after our payment partner(s) have completed fraud screening procedures. You are responsible for providing an email address that is not associated with the domain(s) you are registering under our service.

2. ACCEPTABLE CONTENT

All services provided by Cherished Solutions, LLC may only be used for lawful purposes. Prohibited content includes, but is not limited to:

  • Copyrighted material used without permission
  • Material we determine to be threatening or obscene
  • Pornographic content
  • IRC bots
  • Warez or pirated software distribution
  • Hate sites
  • Hacking programs or archives

3. ZERO TOLERANCE SPAM POLICY

We maintain a zero-tolerance stance against unsolicited email, bulk emailing, and spam. Any user who sends spam will have their account terminated immediately without notice. Cherished Solutions, LLC reserves the right to:

  • Require changes or disable any website, account, database, or component that violates this policy
  • Make emergency modifications at our sole discretion
  • Charge a clean-up fee to the account holder responsible for sending unsolicited email (fee amount at Cherished Solutions, LLC's discretion)

4. PAYMENT TERMS

You agree to provide appropriate payment for services in advance of the service period. Unless you notify Cherished Solutions, LLC of your desire to cancel services, billing will continue on a recurring basis. We reserve the right to modify payment amounts and other charges at any time.

5. BACKUPS AND DATA RESPONSIBILITY

Your use of our services is at your sole risk. Cherished Solutions, LLC is not responsible for files and data residing on your account. You agree to:

  • Take full responsibility for files and data transferred to our servers
  • Maintain appropriate backups of all files and data stored on our servers

6. CANCELLATION AND REFUNDS

Cherished Solutions, LLC reserves the right to cancel any account at any time. Customers may also cancel at any time, subject to the following terms:

  • We provide an unconditional 14-day money-back guarantee on managed shared hosting and reseller solutions
  • No refunds will be issued for cancellations after the initial 14-day period
  • Only first-time accounts are eligible for refunds (returning customers or secondary accounts are not eligible)

7. RESOURCE USAGE LIMITATIONS

Users may not:

  • Use 25% or more of system resources for longer than 90 seconds (including CGI scripts, FTP, PHP, HTTP activities)
  • Run interactive real-time chat applications requiring server resources (remotely-hosted services are permitted)
  • Run standalone, unattended server-side processes
  • Run software interfacing with IRC (Internet Relay Chat) networks
  • Run gaming servers (counter-strike, half-life, battlefield1492, etc.)

8. BANDWIDTH ALLOCATION

You are allocated a monthly bandwidth allowance based on your hosting package. If your account exceeds this allocation, Cherished Solutions, LLC reserves the right to:

  • Suspend the account until the next allocation period begins
  • Suspend the account until additional bandwidth is purchased
  • Suspend the account until you upgrade to a higher-level package
  • Terminate the account
  • Charge additional fees for overages

Unused bandwidth cannot be carried over to subsequent months.

9. MONEY-BACK GUARANTEE

Cherished Solutions, LLC offers a 14-day money-back guarantee for customers who are not satisfied with our services. We reserve the right to issue full or no refunds, at our discretion. We do not offer prorated refunds under any circumstances.

10. PRICING POLICY

The rate you pay for hosting will not increase from your date of purchase. Cherished Solutions, LLC reserves the right to:

  • Change prices listed on our website
  • Increase resource allocations for plans at any time

11. INDEMNIFICATION

Customer agrees to defend, indemnify, and hold Cherished Solutions, LLC harmless from any demands, liabilities, losses, costs, and claims (including reasonable attorney fees) that may arise from:

  • Any service performed or product sold by the customer
  • Any injury to person or property caused by products distributed in connection with our services
  • Materials supplied by customer that infringe on third-party proprietary rights
  • Copyright infringement
  • Defective products sold to customers from Cherished Solutions, LLC's servers

12. DISCLAIMER OF WARRANTIES

Cherished Solutions, LLC will not be responsible for damages your business may suffer. We make no warranties of any kind, expressed or implied, for services provided. We disclaim any warranty of merchantability or fitness for a particular purpose, including loss of data resulting from:

  • Delays
  • Non-delivery or incorrect delivery
  • Service interruptions caused by Cherished Solutions, LLC and its employees

13. DMCA POLICY

Cherished Solutions, LLC complies with the Digital Millennium Copyright Act (DMCA). If you believe that material accessible on our service infringes your copyright, you may notify us by sending a written communication to our designated agent at [your DMCA email address]. Your notice must include:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the material that is claimed to be infringing
  4. Your contact information (address, telephone number, email)
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner

Data Breach Notification

In the event of a data breach affecting your hosted content, we will:

  • Notify you within 72 hours of discovery
  • Provide information about the nature of the breach and affected data
  • Cooperate with regulatory requirements for notification

15. SERVICE LEVEL AGREEMENT (SLA)

Cherished Solutions, LLC strives to maintain 99.9% uptime for our hosting services, excluding scheduled maintenance.

Scheduled Maintenance

We will provide at least 48 hours notice for scheduled maintenance that may impact service availability. Emergency maintenance may be performed with shorter notice when necessary.

16. SECURITY RESPONSIBILITIES

Our Responsibilities

  • Server-level security and updates
  • Network infrastructure security
  • Regular security patches for supported server software

Customer Responsibilities

  • Maintaining application security for your hosted content
  • Regular updates to CMS platforms, plugins, and scripts
  • Implementing appropriate access controls
  • Securing FTP, CPanel, and other access credentials

17. AI CONTENT AND AUTOMATION POLICY

AI-Generated Content

  • Content generated by AI tools must comply with all other terms of service
  • You maintain full responsibility for all AI-generated content
  • Automated content must be clearly identified as such if required by law
  • High-volume automated content generation requires prior approval

Automated Systems

  • Automated systems must not negatively impact server performance
  • API usage and automated requests must be rate-limited
  • Bulk operations must be scheduled during off-peak hours

18. ENVIRONMENTAL POLICY

Cherished Solutions, LLC is committed to minimizing environmental impact through:

  • Energy-efficient server technologies
  • Optimized resource utilization
  • Carbon offset programs for server operations

19. MODIFICATION OF TERMS

Cherished Solutions, LLC reserves the right to revise these policies at any time. Material changes to these terms will be communicated via email at least 30 days before implementation.
